Boards of Registration

The Boards of Registration hear and decide appeals that arise from a voter challenge or a clerk’s decision regarding voter registration.

Each Board of Registration convenes in their respective county on election day. A Board may also convene at the request of the clerk to hear appeals from registered voters and remain convened until all appeals are heard.

There are four Boards of Registration representing the following islands:

  • Island of Hawaii
  • Islands of Maui, Molokai, Lanai, and Kahoolawe
  • Island of Oahu
  • Islands of Kauai and Niihau

Each Board consists of three (3) members appointed by the Governor serving four (4) year terms. In no case shall any Board consist entirely of members of one political affiliation.

Registration Disputes

In a case where the clerk refuses to correct the register or refuses to register an applicant, the person may appeal to the Board of Registration.

Voter Challenge

Any voter who is rightfully in a voter service center, may challenge another voter’s right to vote on the grounds that:

  • The voter is not the person the voter alleges to be
  • The voter is not entitled to vote in that precinct

Any person so challenged will be given the opportunity to make the relevant correction. Otherwise, the challenge will be considered and decided upon immediately by the clerk and the ruling announced.

Voter challenges not made in a voter service center shall be in writing explaining the grounds upon which it is based and be signed by the person making the challenge. The clerk upon receipt of a written challenge shall investigate and rule on the challenge as soon as possible.

Appeals to the Board of Registration

The appropriate Board of Registration hears any appeals to the rulings made by the clerk. Both the challenger and challenged voter has the right to appeal a ruling to the Intermediate Court of Appeals.

Records of Proceedings

Each Board shall keep books of record in which full and detailed minutes shall be preserved of all their proceedings. The minutes shall be kept from day to day and include date and place of meeting, names of members present, the name of each person to whom an oath is administered, name of challenger, the decision of the Board, and all other matters of detail which are likely to have bearing upon the action of the Board or any person appearing before it.

Elections Commission

Act 57 (Bill No. HB 267, 2004) establishes a nine (9) member panel, called the Elections Commission, which replaces the Elections and Appointment Review Panel.

The Elections Commission is composed of the following:

  • Two (2) members appointed by the Senate President
  • Two (2) members appointed by the Senate Minority Leader
  • Two (2) members appointed by the House Speaker
  • Two (2) members appointed by the House Minority Leader
  • One (1) member selected by a two-thirds vote of the Elections Commission to serve as Chairperson

Each group of four (4) Elections Commission members selected by each house will include (1) member from each of the four counties: Hawaii, Maui, Kauai, Oahu.

A person from the same county as the departing Elections member will fill a vacancy in the Elections Commission. If the vacancy is not filled within fifteen (15) days, the Chief Justice of the Supreme Court will fill the vacancy.

Duties

The duties of the Elections Commission provided under Hawaii Revised Statutes §11-7.5 are as follows:

  • Hold Public Hearings;
  • Investigate and hold hearings for receiving evidence of any violations and complaints;
  • Adopt rules pursuant to chapter 91;
  • Employ, without regard to chapter 76, a full-time Chief Election Officer, pursuant to section 11-1.6; and;
  • Advise the Chief Election Officer on matters relating to elections

暫定投票 (Provisional Voting)

Help America Vote Act of 2002 (美國投票協助法案2002)(HAVA)規定選民有權投一張暫定選票,如果基于以下原因 :

  • 選民的名字沒有出現在官方選民名單上;或者
  • 一名選舉辦事員斷言該個人沒有資格投票。

失敗-安全投票(Fail-Safe Voting)

一名失敗-安全選民是指第一次選民已登記爲選民通過郵寄投票而沒有提供必需的HAVA身份證,無論是在登記的時候還是在投票點或者試圖將缺席選票返還給選舉辦的時候。在這種情况下,該選民可以提交一張暫定選票。然後該選民必須向選舉辦事員辦公室提交可接受的身份證明,這樣該選票才能被統計,在以下到期日之前:

初選:2020年8月11日

大選:2020年11月5日

投一張暫定選票(Casting a Provisional Ballot)

選民被允許投一張暫定選票,只需填寫一張確認聲明說明該個人是以下人員:

·         是在管轄範圍內的已登記選民想參加投票;而且

·         在選舉時有資格投票。

選舉辦事員辦公室將根據州法律决定是否將一張暫定選票計入總數。選民可以驗證是否該選票已經或者尚未被統計,以及爲何它沒有被統計,撥打免費電話或者通過選舉辦公室網站 www.electionsdev80.hawaii.gov.

州憲法修訂 (State Constitutional Amendments)

Hawaii State Constitution (夏威夷州憲法)只能通過憲法會議或者立法院提議進行憲法修訂由全體選民表决。夏威夷州憲法不支持倡議程序。

憲法會議(Constitutional Convention)

立法院會提交一下問題給選舉辦公室要求在選票上印列一下問題,“是否需要舉行憲法會議以建議修訂或修改憲法?”

如果在以上問題印列在選票上已經達九(9)年,副州長必須提交此問題到辦公室以印列在選票上。2008年大選是上一次選舉時該問題出現在選票上。

如果該問題受到多數選票贊同,包括空白和過度投票,那麽就必須舉行憲法會議。

立法院會爲會議提供代表數量,將被選舉出來的區域,以及會議即將召集的方式。選舉代表會在下一個大選或者某個特殊選舉時進行,依照立法院的决定。

在憲法會議上,建議的憲法修訂或修改會被决定幷提交給選舉辦公室以列印在大選或特殊選舉的選票上。

在大選時,該問題就會被批准,只需要達到以下兩個合格條件:

  • 測試1:是的選票得到計票多數支持,不包括空白和過度投票
  • 測試2:是的選票至少達到總計票總數的百分之五十,包括空白和過度投票

在特殊選舉時,該問題就會被批准,只需要達到以下兩個合格條件:

  • 測試1:是的選票得到計票多數支持,不包括空白和過度投票
  • 測試2:是的選票構成超過夏威夷已登記選民總數的至少百分之五十

立法院建議修訂(Amendments Proposed by the Legislature)

立法院建議憲法修訂必須被每届立法院會議整個議事廳三分之二的投票所接受,或者連續兩届立法院會議被整個議事廳多數投票所接受。

建議憲法修訂的問題被提交給選舉辦公室以在大選時印列在選票上。

該問題只需要達到以下兩個合格條件就會被批准:

  • 測試1:是的選票得到計票多數支持,不包括空白和過度投票
  • 測試2:是的選票至少達到總計票總數的百分之五十,包括空白和過度投票

最後期限 (Deadline)
一個問題提交給選舉辦公室以列印在選票上的最後期限是 2016年8月25日.

195,909 是 / 318,363 計票數 = 0.615 或 61.5%

61.5% 大于50%, 因此收到是的投票數占計票總數的多數,因此通過測試 1.

測試 2 計算:
195,909 是 / 348,751 投票數 = 0.562 或 56.2%

56.2% 大于50%, 因此收到是的投票數超過投票總數的50%因此通過測試 2.

該問題通過了測試1和測試2因此修訂被批准了。

27.8% 少于 30%,因此它沒有通過測試 2.

該問題通過了測試1但是沒有通過測試2因此修訂不被批准。

選民挑戰 (Voter Challenges)

任何已登記選民有權對另外一個選民的權利進行挑戰基于以下情形:

  • 這個選民不是所聲稱的選民本人。
  • 該選民無權在該選區投票。

選民挑戰不是發生在投票點(Voter Challenges Not Occurring In A Polling Place)

如果選民挑戰不是在某個投票點完成,包括提前到場投票點,那麽就必須以書面形式,解釋挑戰所根據的基礎幷且由挑戰者簽名。選舉辦事員收到書面挑戰書必須儘快進行調查和做出裁决。

選舉辦事員會通知被裁决的選民告訴他/她有權在裁决之後的十(10)日內就該裁决上訴到Board of Registration (登記委員會)。

對選舉辦事員裁决的申訴(Appeal of Clerk’s Ruling)
被挑戰的選民必須提交一份書面申訴給登記委員會,在選舉辦事員做出裁决之後的十(10)日內。書面申訴書必須包括:

·         被挑戰選民的姓名。

·         選舉辦事員的裁决聲明

·         被爭議的基礎

如果一個上訴持續遞交到Board of Registration(登記委員會),那麽該委員會必須馬上將該事件通知選舉辦事員。

在聽證會結束時,委員會可以給出一個口頭裁决或者對該事件再適當考慮然後再稍後日期發出一份書面裁决。

委員會會通知被裁决的人員,告訴他/她可以上訴到中級法庭,不遲于委員會的書面裁决發出之後第10天下午4:30 p.m.

選民挑戰發生在投票點(Voter Challenges Occurring In A Polling Place)

選民挑戰可以在選舉日的投票點或者提前到場投票點發生。挑戰不一定要書面形式的。被挑戰的選民被允許做出相應的改正。

否則,選區官員必須立即對挑戰進行考慮和做出裁决。挑戰者和被挑戰者可以上訴到登記委員

如果沒有上訴,那麽選區主任的裁定就是最終裁定。被挑戰的選民依據裁决結果可以相應被允許或者被禁止投票。

對選區官員裁决的上訴(Appeal to the Precinct Officials’ Ruling)
挑戰者和被挑戰者都可以上訴到登記委員會。上訴必須在被挑戰選民正常投票之前提出,或者挑戰者選民離開投票點之前作出上訴。

依據對上訴書的裁决結果,被挑戰者將會允許已被挑戰的投票計入總數或者被拒絕統計。

委員會必須討論該挑戰幷根據上訴做出裁决。委員會必須通知選區主任或選舉辦事員他們的裁决。

委員會討論紀要,委員會的裁决,和裁决做出的原因等必須記錄在委員會備忘錄上。

選區主任必須通知挑戰者和被挑戰者關于委員會的裁决。

選區主任還要通知被裁定的人員他或她可以就委員會的裁决向中級上訴法庭進行上訴。

如果沒有上訴,那麽被挑戰的選票就必須被計入或者被否定,幷依據法律規定保存起來。

如果提出上訴,那麽該選票必須由選舉辦事員辦公室監管,以根據對上訴書的裁决被計入或者被否定,幷且登記簿上也必須得到更正以和法庭裁决保持一致。

在所有時間內,被挑戰選民的選票秘密必須得到保障。

所有有關挑戰和裁决文件都必須附在會議備忘錄作爲每個登記委員會的記錄保存。
